The court adopted the proposal of the prosecutor of Edra, who requested the guilt of the police officer for the death of the 23-year-old motorcyclist, characterizing the policeman’s negligence as “serious and cumulative”. The judges denied the accused the recognition of the mitigating factor of the previous legal life that he requested through his lawyer because, as stated by the defense, he has never been involved with the authorities and has a clean criminal record.

The prosecutor also submitted a similar proposal rejecting the mitigating factor, who stated that the accused did not demonstrate legal behavior in violation of the Code of Criminal Procedure. “The behavior he displayed during the traffic accident was not an inconsistency,” the public prosecutor emphasized.
