The plenary session of the ADAE under Mr. Christos Rammos, with votes 4-3, decided to request the full file from the EYP regarding the monitoring of Nikos Androulakis. According to the report of Yiannis Souliotis in “Kathimerini”, the ADAE itself will then decide whether the disclosure of the file endangers the purpose for which the privacy of Nikos Androulakis’s communications was sought. It will then inform him of its judgment, always under decision 465/2024 of the plenary session of the Council of State which deemed the relevant law of 2021 unconstitutional, following the appeal of N. Androulakis.

Thus, the way is opened, in an absolutely institutional way, to put an end to the case of his surveillance that poisoned the political life of the country and the relations of New Democracy with PASOK. Based on all the data, any refusal of the EYP to hand over the relevant file to the ADAE will be unjustified and will show that the causal judgment is weak. However, I believe that from the moment that all the formulas were observed – as it appears from the subsequent (exculpatory) check on whether the prosecutor of the EYP acted lawfully -, i.e. the connection was formally legal, then her rationale will logically be valid as to its essence.

And from here things begin to acquire a great interest, primarily political. What will ADAE do? Will he inform the leader of PASOK or will he judge that informing him compromises the purpose for which he was being monitored? It should be noted that the minority opinion in the AIA maintains that, despite the information of the Independent Authority by the EYP, the right to the information of Nikos Androulakis remains with the EYP itself.

Of course, if the ADAE decides that Nikos Androulakis should not be informed, this will mean that the reasons for monitoring him were particularly serious, which probably exonerates the EYP, not to say that it vindicates it. However, if ADAE informs the leader of PASOK, then the problem is transferred to him. What will he do? Will he inform the citizens why the EYP was monitoring him? Apparently that will do too. He has no other choice. Thus, he takes a big risk if the reason for his surveillance is reasonable or plausible.

From all of the above, it follows that now that things have arrived, as they have arrived, for the government, the liberating only way is for the EYP to satisfy ADAE’s request for information.
