The findings of the Body of Inspectors and Auditors of the Ministry of Environment and Energy in Mykonos

Controls are being intensified in tourist destinations

Following a government decision and an order from the leadership of the competent Ministry of Environment and Energy, inspections were carried out by Inspectors of the Corps of Inspectors and Auditors, in Mykonos.

With the aim of complying with urban planning legality, respect for the natural and urban environment, as well as the right of free access of citizens and visitors to the coasts, from last year in April until today, the Construction and Demolition Inspectors have visited the island five times (specifically on 03.04.2023, on 10.04.2023, on 14.07.2023, on 21.12.2023 and on 01.04.2024). They conducted intensive inspections to detect illegal construction in 13 businesses and one private project and monitored demolition and compliance procedures.

It is noted that the checks are in full progress and will continue both in Mykonos and in other tourist destinations, the findings of which will be made public by the Ministry of Environment and Energy.

The following are, in detail, the findings of the Body of Inspectors and Auditors of the Ministry of Environment and Energy in Mykonos:

PRINCIPOTE
During the first autopsy, on 11.04.2023, a finding had been drawn up that included arbitrary constructions, closed areas used for storage, bars, toilets, shopping centers, etc., with a total area of ​​9,200 sq.m., pergolas and a wooden floor area of ​​5,300 sq.m., paving of the field with concrete 21,500 sq.m. and a 300 m wooden wall, which closed public access to the shared beach of Panormos. Autopsies were then carried out at the business in July and December 2023 to monitor the demolition procedures. In April 2024, all the arbitrary constructions were demolished. The constructions that had evidence of legitimacy (building permit and affiliations) have remained.

PASAJI
Arbitrary constructions were found in the company, such as pergolas of 60 sq.m., curtain walls of 14 sq.m., closed spaces of 107 sq.m. and wooden curtains of 40 sq.m. The part of the business that extends with a pergola and a semi-outdoor area in front of the seafront and the beach has been subject to a trespass law and the competent Building Service (YDOM) has been requested to check the subordinations. demolition of the unauthorized buildings, for which the appeal to the Central Council for Urban Planning Issues and Disputes (KESYPOTHA) was not accepted and it has been established by a private Building Inspector.

KUZINA
In the company, license violations were found in all wings of the hotel and in the KUZINA restaurant. Specifically, these constructions were semi-outdoor areas, 50 sq.m., closed areas 200 sq.m., gym, etc., walls 50 sq.m. and wooden bridge. However, an objection was filed with the KESYPOTHA, where most of these arbitrary constructions were shown to have been subject to the unauthorized constructions law, while the rest of the arbitrary constructions that were not included, were demolished by the owner. For the legality of these affiliations, a relevant document with data has been sent to the competent YMCA.

AEONICSUITS&SPA
An autopsy was performed on 10.04.2023 and 01.04.2024. An inspection of the hotel accommodation was carried out, according to the approved (as of January 2018) building diagram, and it was found: conversion of underground areas of the pumping station and engine room into areas of rooms with jacuzzi, closed areas of the bar, restaurant, in the place of the old pergola, above-ground storage areas, additions to the level 3, indoor and semi-outdoor areas with hotel use, gym, spa, etc., with a total area of ​​2,000 sq.m. The company has filed an appeal with KESYPOTHA and it has not yet been finalized. In the next phase after this finality, an autopsy will be carried out to monitor the case and impose the relevant sanctions.

Alemagou
During the autopsy of April 2023, arbitrary constructions were identified, mainly of auxiliary use as storage areas for materials and roofs, with a total area of ​​440 sq.m. The April 2024 mixed level post-mortem found the business to be in compliance with the removal of permit structures/exceedings. At the same time, a new, small-scale permit was issued for “outside design, addition of pergola with windbreak, pergola for parking area and repair of existing shop area pergola and installation and removal of event platform and design of surrounding area”. The work related to the above approval had not been completed, while no new excesses were found.

Superparadise
During the autopsy of April 2023, arbitrary constructions were identified, mainly for auxiliary use (storage areas) and additions by extension of buildings, with a total area of ​​181 sq.m. During the autopsy of the mixed level in April 2024, it was found that the company complied with the removal of the arbitrary constructions, except for an arbitrary wall inside the plot, which separates the northern forecourt, for which the company has appealed to the Central Council of Town Planning Affairs of Ministry and the Council’s decision is still pending. For the arbitrary constructions identified by the echelon and included in an arbitrary law, a document was sent by the Service to the competent YMOD to check their legality due to the time of construction, however it has not yet responded. No fine decision has been issued.

Lohan
During the autopsy of April 2023, arbitrary constructions, mainly of auxiliary use, were identified as storage areas and additions by extension of buildings with a total area of ​​970 sq.m., as well as constructions/configurations in front of the store within the seafront/beach. During the autopsy of the April 2024 mixed level, the company was found to be in compliance with the removal of all arbitrary structures.

Solymar
During the autopsy of April 2023, arbitrary constructions related to small extensions of a building area of ​​68 sq.m. were detected. and configurations inside and outside the plot and seafront/beach, 500 sq.m. The company has appealed to the Central Council for Town Planning and after its decision a building fine was imposed for the arbitrary constructions that remained. The autopsy of the April 2024 mixed echelon found partial compliance as some structures were found to have been removed.

Santanna
During the autopsy of April 2023, arbitrary constructions, mainly of auxiliary use, with a total area of ​​46.77 sq.m., were identified. and configurations of a wooden platform within a seaside beach, surface area 177.60 sq.m. During the post-mortem of the April 2024 mixed level, the company was found to be in compliance with the removal of arbitrary structures.

Jakie-O Castle Country
During the autopsy of April 11, 2023, in front of the store, an arbitrary construction was found in extension of the building and within the common area, with a total area of ​​45 sq.m. The company accepted the Conclusion – Autopsy Report of the audit level and followed the compliance process for its dismissal by the same means, however, in a subsequent autopsy of the level in April 2024, partial compliance of the company was found. An erection and maintenance fine was imposed on the company in question for the structures that remained.

Jakie-O Super Paradise in Plyndri
During the autopsy on April 10, 2023, arbitrary constructions made of metal and wood were identified, which housed spaces mainly for auxiliary use, with a total area of ​​226 sq.m. The company accepted the Conclusion – Autopsy Report of the control level and followed the compliance procedure for its dismissal by the same means, which, however, delayed beyond the – by law – deadlines and fines were charged to it. However, in a subsequent autopsy of the echelon, on April 2, 2024, it was established that the business was in compliance and that all the arbitrarily roofed, auxiliary spaces of the finding were removed.

NAMMOS
A Demolition Protocol had been drawn up by the Service of the Ministry of Environment and Energy, because during the on-site inspection by a team of Inspectors, on 04.04.2023, it was found that extensive construction work was being carried out without a building permit, in buildings operated by the company under the name “NAMMOS”. Part of the building, which is included in the demolition protocol, was built inside the seafront. This will immediately be followed by an on-site inspection by a team of Inspectors of the Service, in order to confirm the findings of the conclusion of the competent Building Inspector from 03.06.2023, according to which parts of the arbitrary buildings that were included in the Demolition Protocol, including those within the seafront, have already been demolished and will be followed by an on-site inspection by the House.

On a different plot of land belonging to the company “NAMMOS”, after an on-site inspection by a team of Inspectors on 03-04.04.2023, the Conclusion was drawn up from 28.09.2023, regarding arbitrary extensions of the buildings of the order of 500 sq.m., using commercial stores and focus. This will immediately be followed by an on-site inspection by a team of Inspectors of the Service, in order to check whether the arbitrary constructions in question have been demolished.

SCORPIOS
In the on-site autopsy on 04.04.2023, the following arbitrary constructions were found in the off-plan area where the company “PARAGA AE” operates: 11 containers with a total area of ​​145 sq.m., 3 plastic tanks, 6 pergolas with a total area of ​​303 sq.m., 8 stone walls with a total length of 36 m and an average height of 2.5 m, arbitrary covering of rabote pergola surface 56 m2, arbitrary ground floor building of stone masonry with a surface area of ​​24.3 m2, arbitrary ground floor building of stone masonry with a surface area of ​​24 sq.m. and an arbitrary ground-floor stone building with a surface area of ​​89 sq.m. During the on-site inspection on 02.04.2024, it was found that the following have not been removed: the ground floor stone building with a surface area of ​​89 sq.m., the ground floor stone building with a surface area of ​​24 sq.m., the container (DEDDIE substation) with a surface area of ​​12 sq.m. . and the perimeter walls of the ground floor stone building, the roof of which was removed, for a height greater than the 1.5 m permitted under the New Building Regulations (NOK).

BUILDING AT “MOROERGO” FTELIA

An on-site inspection was carried out on 21.12.2023 in the “Moroergo” – “Ftelia” area of ​​Mykonos, on the property for which a temporary Subordination to law 4495/2017 and a building permit for the completion of work on an arbitrary residence – hostel and swimming pool had been issued, with the law. 4495/2017 of YDOM Syros. During the on-site inspection, extensive construction works were found in progress and in particular: excavation and excavating works, concreting of the roof slab of the hostel building, construction of new stone walls in progress, which are not covered by the outdated Subsidiary to Law 4495/2017. For this specific construction, there were overpasses identified by the AT, from 2011. From the data collected, it emerged that the constructions included in the delayed Subject to Law 4495/2017, were built after 28.7.2011 and were therefore illegally subject to Law 4495 /2017. Then, after activation of the competent YMCA, the latter proceeded to: Decision to revoke declaration of compliance with the regulation of law 4495/2017, Decision “Revocation of the Building permit of YMCA of Syros, in the area of ​​Ftelia Mykonos and issued “Stopping of Construction Works” . During the most recent on-site inspection carried out by a team of Inspectors on 04/01/2024, it was found that construction work had continued at a time subsequent to the interruption of construction work. In particular, the retaining wall north of the building had been extended in height.
