On the grounds that a previous corresponding decision of the municipal council had been deemed illegal, the construction works continue as normal. “The municipal council of Kalamaria is attempting for the third time to suspend the construction works on the plots of Sophouli, without having such authority. This time the city council is citing a request from residents, who asked for something like this. All this was done despite the fact that the legality of the two building permits has been repeatedly ruled positively by the competent Courts, while the application for suspension submitted by the residents was deemed inadmissible just a few months ago. Therefore, no administrative body and no petition can overturn these court decisions, which are binding,” he explained to Voria.gr the attorney of the owners, Thanos Charistos.

Mr. Charistos also noted that it has been publicly admitted that the competent employees of the urban planning authority of Kalamaria are under pressure from elected officials, in order to obey and ignore these court decisions. “Within the next few days, an indictment will be filed with the competent authorities, in order to investigate who is involved in forcing the resignation of the former head of YDOM of Kalamaria and in her replacement because of this case. Unfortunately, we are in front of a methodical attempt to violate any concept of legitimacy, which has now exceeded all limits. The owners do not intend to show any tolerance this time,” he said characteristically.

The timeline of the licenses in question

As he mentioned, the first application for the issuance of a building permit for the construction of a building with total m.t. 100.00 on each plot of land was deposited in 2006. At that time, as he said, the reaction on behalf of the town planning department and by extension the municipality was strong, with excuses without a town planning basis and with the ultimate goal of delaying the issuance of building permits.

“In the year 2012, the two building permits were issued, and we subsequently revised them, in order to use our property in the best possible way. Then the municipality of Kalamaria invented the “tool” of its amendment General Urban Plan, since he had already abandoned the redevelopment plan. In the provisions of the GIS, there is the possibility according to Law 2508/1997, because the GIS is a time-consuming process and the development of each area should not be stopped until its completion, as long as there is an intention to rebuild and a complete file has been submitted for the issuance of a building permit in the competent urban planning, the previous law can be applied, even six months after the signing of the new GIS. In our case, the revised permits were issued in the year 2014, and the GIS was signed in the year 2015, one year later. And obviously our plots were not included in the green space of the GIS revision, on the one hand because the GIS manages building blocks and not individual plots, on the other hand because building permits had already been issued under the previous law,” he noted.

After the revised permits were issued, the owners rang the construction bell and did not start work immediately, but left a margin of ten years to the municipality of Kalamaria, in order to decide what it can and should do. “How long did we have to wait? In this case, we are the victims, as we have been receiving daily bullying from representatives of the Municipality, from residents of the area and from various collectives, who are doing everything they can to reduce our property, from the year 2008 until today. using any legitimate but also mostly illegal means, spreading inaccuracies and false information. It is quite clear that if our plots were owned by any of the above, they would have been fully erected long ago, without any objections from anyone. I can’t imagine that anyone of all those who oppose today has already donated or intends to donate his property to the Green Fund”, emphasized Mr. Kotoulas.

Regarding the location of the building being erected, the owners emphasize that it does not touch the beach front, like other buildings, but with Sofouli.

The new declassification procedures and the proposed solution

According to information from Voria.gr, there are at least 30 other owners of neighboring properties, who will start the declassification process in the next period, considering that there is no prospect of compensation for them.

Given that the time limit for the implementation of the GIS is coming to an end and the rest of the plots must be released, in addition to those of the Cooperative and the Autonomous Organization that have already been released, the owners propose a specific solution. As Mr. Kotoulas explained, “after consultation between the municipality and the private owners of plots of land on the Kalamaria beach front, the municipality should proceed immediately with the creation of green and recreational areas, choosing which properties will be included in them, leaving the rest of the land free for exploitation , whose ownership regime will include the owners of the properties that will be included in the green areas and to prepare an architectural design study, so that the buildings under construction are uniform and in harmony with the environment.”
