Easter gift and three years are coming under the microscope of the Labor Inspectorate, which is expected to intensify controls, on the one hand due to the holidays and the obligation to give the gift by Holy Wednesday and on the other hand due to the completion of the month of April, and the incorporation into the salary of the increases that valid from April 1st. Audits by the independent authority will focus on wage issues and high fines are expected to be imposed in cases where labor laws are violated.

After all, on April 18, the Labor Inspectorate announced the legal framework applicable to the payment of the Easter gift, noting that if employers do not comply with the specific period of time, within which they must settle their obligations, then they will also suffer the consequences of law, as non-payment of the Gift constitutes a criminal offence.

The Federation of Private Employees requests the intervention of the Labor Inspectorate

In fact, it calls on its employees and the unions where they find the non-payment of the gift to appeal to its local services, while noting that they have an additional right to file a lawsuit, so that the automatic procedure can be initiated.

At the same time, the labor inspectorate will check the granting or not of the three years, which were reinstated at the beginning of the year and their granting is mandatory.

In fact, the Federation of Private Employees requested the intervention of the Labor Inspectorate as the problem “continues and intensifies” with the non-payment by many employers of the three-year seniority allowance (10%).

The largest Federation of the country in its statement complains that “the majority of workers do not receive what the law provides for, either for fear of dismissal or because of the various tricks used by employers and businesses”.

The controls

In the near future, according to the planning of the independent authority, it is expected that audits will be carried out in companies, in order to establish potential violations around the following:

– The granting of the increase of the minimum wage to 830 euros and the minimum daily wage to 37.07 euros, from April 1st.

– The increase due to seniority for those employees who are paid the minimum statutory salary or daily wage (three years and salary maturities).

– The submission to the ERGANI system of the change in salary, which is provided for by law or regulatory act or by a Collective Labor Agreement, such as the increase in the minimum wage, within 30 days of its implementation.

– The registration in the ERGANI system, until April 30, of the details of the employees who received the annual leave and the leave allowance for the previous calendar year 2023.

-The payment of the Easter allowance, until Holy Wednesday.

-The application of the digital job card.
