From today, Monday, April 22, until May 4, 2024, the godfather basket is implemented in game stores.
The basket contains:
Easter candles – toys
Board / Puzzle
Doll toys, dollhouses and other accessories (imitation toys)
Baby toys
Action figures
Construction and building games (eg brick games)
Vehicles – Remote Controlled
Electronic games
Sports toys (eg balls, children’s basketballs and goals)
A soft toy
Musical toys
Chocolate eggs and similar products (optional)
What toy stores need to know about the godfather’s basket
Game stores whose total turnover exceeds 1,000,000 euros per year are obliged to participate in the godfather’s basket
which should ensure that the products participating in this measure are in sufficient supply in their stores and are available to the consumer without interruption. While the violators will be asked to pay a fine from 1,000 euros to 10,000 euros.
In detail, in article 1 of the proposed provision entitled “Observatory of prices of children’s toys “the basket of godfathers”” of the amendment submitted to the bill of the Ministry of National Economy and Finance for the reform of the Tax Procedure Code (TPC). states the following:
Businesses specializing in the sale of children’s toys to the consumer public, whose total annual turnover exceeds 1,000,000 euros per year, based on the financial statements of the immediately preceding, from the entry into force of this, management period, send to the Ministry Development, at regular intervals, of a list of consumer products for children’s toys (“godfather’s basket”), from April 22, 2024 until May 4, 2024.
Those liable under paragraph 1 include at least one product from each product category included in the “godfathers’ basket”, if they have products of this category, and make them available at an affordable price, especially compared to other products of the same category, informing consumers , who come to their physical or digital stores, in terms of the composition of the “basket” they propose. This information is provided by any suitable means, in particular with lists, brochures and, mandatory, with special markings on the products or their sales area.
Those liable under paragraph 1 place a clear special sign in the sales area (shelf) of the products participating in the “godfather’s basket”, as well as a clear list of the products that make up the “basket” in a visible place at the entrance of the store, which includes the prices at which the products are offered. In addition, the persons liable under paragraph 1 ensure that the products participating in the “basket” are in their stores in sufficient quantity and are available to the consumer without interruption. A fine of 1,000 euros to 10,000 euros is imposed for each violation of the present, according to the decision of par. 7.
The list of products participating in the “godfather’s basket” and their prices are set freely by the companies. For the prices of the products that make up the “basket” proposed by each company, article 54 of Law 5045/2023 (A’ 136), on unfair profit-making, is applied accordingly, where the gross profit margin per product unit is not allowed to exceed the corresponding gross profit margin per product unit before December 1, 2021. The products in the list can be varied each time a new list is sent by the obligees to the Ministry of Development.
A list of products included in the “godfather’s basket” can also be sent by companies other than those liable under par. 1. The aforementioned companies, if they send a list of products, are obliged to comply with this, until its expiry, and are controlled by the competent audit authorities regarding their compliance with article 54 of Law 5045/2023, on unfair profit making.
The non-sending of a product catalog or the incomplete sending of a product catalog by the debtors is punishable by an administrative fine of 5,000 euros for each day of delay in sending the catalog.
