The former prosecutor of First Instance of Corfu, who had been accused of felony, fell into the trap abuse of power in true real confluence and for embezzlement of public documents in confluence.
The Three-member Court of Criminal Appeals of Ioannina imposed on her 5 years imprisonment with a suspensive nature, however, without the construction of a single day while acquitted the former deputy head of the Office of the Prosecutor’s Office who was also accused of synergy in the criminal act.
The former prosecutor who has ceased from her duties from April 2022 without the right to work, appealed against the decision of the Tripartite Court of Appeal. Her lawyer, Nikos Agapinos, states in his statement that “this is a punishment that is appropriate for a misdemeanor (imprisonment) and suspended without serving even a single day, and in fact by majority as one member of the court decided that she should be declared completely innocent, a decision that will be taken after certainty, the Five-Member Court of Appeal to which our ex-mandatory Prosecutor has already appealed, solely for the defense of her honor, as the first instance sentence imposed on her is not suspended but suspended”.
“Interesting jurisprudentially will be the decision that turned the multitude of criminal charges into one consecutive for the offense of abuse of power, while it should be noted that two mitigating factors were recognized for the accused and the decision was suspended until the second degree” concludes Mr. Agapinos in his statement.
