The three-member Criminal Appeals Court of Ioannina imposed a 5-year suspended prison sentence on the former Corfu First District Prosecutor for the thousands of lost case files.
The former prosecutor of First Instance of Corfu was accused of criminal abuse of power in real and actual confluence and of embezzlement of public documents in concurrence.
At the same time, he acquitted the former deputy head of the Secretariat of the Prosecutor’s Office, accused of complicity in the criminal act.
Ms. Tataki appealed the decision.
The case was revealed in 2019 by the then appeals prosecutor of Corfu and her former supervisor, Vasiliki Christouli, after a systematic investigation, following complaints that reached her office.
The former prosecutor, by unanimous decision of the Plenary of the Supreme Court on April 14, 2022, was dismissed from the House without the right to work.
Nikos Agapinos, who represented the former prosecutor, said in his statement: “A sentence appropriate to a misdemeanor (imprisonment) and with suspension without serving even one day was imposed on the accused former prosecutor and in fact by a majority as a member of the court decided how she should be declared completely innocent, a decision that will surely be taken by the Five-Member Court of Appeal to which our ex-mandatory Prosecutor has already appealed, solely to defend her honor, as the first instance sentence imposed on her is not suspended but suspended.
Jurisprudentially interesting will be the decision that turned the multitude of criminal charges into one consecutive for the offense of abuse of power, while it should be noted that two mitigating factors were recognized for the accused (as requested) and the decision was suspended until the second degree”.
