Based on the building factor that applies in each area, the height of the buildings will now be determined, with an amendment submitted by the Ministry of Environment and Energy to the multi-legislation on urban planning and energy provisions that is being debated in the committees of the Parliament.

After the uproar that erupted from the decisions of the 5th section of the Council of State regarding the bonuses of the building regulation and the reactions from local government representatives regarding their implementation, the Ministry of the Environment is proceeding to amend the institutional framework with provisions of a transitional nature that will apply until the completion of urban planning. The relevant regulation will come into force from May 1 until the end of 2025.

Based on the new provisions, which will have a staggered structure for a factor of 0.8, the additional height will not exceed 2 meters, which means that an additional floor will not be able to be built. For a coefficient from 0.8 to 1.6 the additional height will not exceed 2.5 meters and for areas with a building coefficient greater than 1.6 the permitted height will be an additional 3 meters.

For planted roofsthe law adds the following: “the content of the file of supporting documents and the individual specifications of plans and technical report, which are submitted to the competent agency for the construction of a Planted Surface, the method of carrying out and the periodicity of the checks for compliance with the terms herein, the amount of fines in favor of the Green Fund in case of non-implementation of the above technical report, as well as any other related issue are determined by the decision of the Minister of Environment and Energy.”

In another point of the amendment, it is stated that for building permits for buildings with zero energy consumption, as well as for the creation of planted surfaces, in addition to the prescribed controls, a repeat control is carried out every 5 years by different Building Inspectors each time.

In explanatory statement of the amendment, it is noted that the modification of the framework is deemed necessary as there is an urgent need to provide directions in order to avoid any changes in height, which, although as a condition constitutes an unfavorable change in conditions in itself, it can be argued that they lead to an alteration of the physiognomy of an area and by extension in vulnerability of the upcoming building permits.

It is emphasized that the new provisions have transitory character until the approval of of Local Urban Plans and limit the application of the incentives so that: a) from now on they are not created in terms of their influence on the physiognomy of the areas, and b) to avoid vulnerability of the building permits for reasons of application of the NOK incentives. As emphasized, this limitation of incentives is not horizontal, but is related to the special characteristics of the areas, as they are reflected in the current permitted building factor applied in these areas.
