According to decision of the A1 Political Department of the Supreme Court which declared the parties and coalitions of parties, which have the legal conditions to participate in the European elections of June 9, 2024, as the main reason for excluding the party of “Spartans” was the initiation of criminal proceedings against its 11 deputies for complicity in defrauding voters by complicity. The criminal prosecution against the 11 deputies was brought by the prosecutor of the Supreme Court, Georgia Adelini.
At the same time, according to the Areopagite decision the real leader of the “Spartians” party is “Golden Dawn” member Ilias Kasidiaris and the 11 deputies of the “Spartans” of “they actually offered their party as a cloak for a new political party to Ilias Kasidiarismaking it easier for him to circumvent the eligibility restrictions set by the electoral legislation”, point out, among others, the Areopagites.
In more detail, the Areopagites out of the 122 pages of their decision, 86 pages concern the reasons why the “Spartiates” party was cut, chronicling the route, action and statements of Ilias Kasidiaris for the “Golden Dawn” party, but and the later period after the founding of the “Spartans”, as well as his condemnation.
The decision of the Supreme Court, referring to the actions of Ilias Kasidiaris, points out that in all the closed meetings he organized, “a large number of prominent officials and candidate MPs of “Golden Dawn” participated, some of whom are still today MPs of the “Spariates” party“”.
And the judges add: “It is demonstrated that Ilias Kasidiaris, real leader of the party “Spartiates”, which replaces “Golden Dawn” never disapproved or demobilized, even in the slightest, the previous one – as a leading member of “Golden Dawn” – hate speech, his violent and racist action, in the context of the criminal mechanism of the aforementioned party, copying the institutional mechanisms of the Greek state, the intended policy of destroying the democratic institutions of the rule of law and the disapproval of the rights and freedoms recognized by democracy”.
Furthermore, the decision of the Supreme Court states: “In this case, it appears that the party “Spartiates”, whose real leader is Ilias Kasidiaris, doomed to a total sentence of 13 years and 6 months for the crime of joining and directing the criminal organization “People’s Association – Golden Dawn” and the illegal possession of a firearm, which he is serving, promotes a policy that does not respect democracy and aims to weaken and subversion of the democratic polity and the institutions of the rule of law, in particular by the use of violence or the incitement to violence, as well as the justification thereof, the promotion of totalitarian ideologies, the spread of racist and intolerant ideas and xenophobia, the condonation of crimes against humanity, hatred against persons and groups, actions and declarations that threaten the peaceful coexistence of social groups in the country. Following the above, the party “Spartiates” must not be declared and therefore not participate in the elections for the nomination of the members of the European Parliament on 9-6-2024″.
