Awaiting the decision of the Supreme Court

When on April 9, the 5th section of the Council of State issued the decision to temporarily suspend the operations of the Fly over. Thessaloniki “froze” seeing yet another project in danger of going to the Kalends.

The president of the 5th Department of the Council of State, Margarita Gortolidou, ordered the freezing of the works in view of the debate in the CoE that took place in mid-April.

On 16/4, two applications for the cancellation of the project were discussed, which had been submitted by the Residents’ Association of Constantinople Settlement, the Sheikh Sou Protection Association and the Thessaloniki Runners’ Association.

According to the representatives of the entities that appealed against the project, the ministries had not submitted the three necessary studies (traffic, road construction and statics).

In that discussion, the government (Ministry of the Environment) submitted outdated data, while for the lands under expropriation it was revealed that the area to be logged is 187,000 square meters and not 82,000 square meters, as originally reported.

This difference, as confirmed by both the contractor company and the State during the discussion at the CoE, consists of incorrect technical calculations of the initial study.

For this new parameter, however, the possibility of a new annulment appeal remains open as it is a new element that was not considered initially.

The discussion on the cancellation of the project has been set for May 22, while the trial of the appeals of the owners whose properties are planned to be expropriated has been postponed to September 16 in the civil courts of Thessaloniki.
