Today, a 21-year-old man from Voliotis was found guilty of raping his ex-girlfriend, who sat in the dock at the Criminal Court (Mixed Jury Court) of Larisa, facing the charge of raping his ex-girlfriend, the same age, during a coming-of-age party held at home mutual friend of the two children, who was 18 years old when the crime was committed.
The defendant was referred to trial by decision of the Council of Misdemeanors of Volos. Yesterday the court sentenced him to 5 years in prison without parole, recognizing the mitigating factor of being a teenager. The 21-year-old exercised his right to appeal and was released.
It is worth noting that the prosecutor had earlier proposed the acquittal of the accused due to doubts.
He stated that in this specific case the fact of intercourse is “undeniable”, adding that for the exercise of violence there is no objective evidence such as a forensic examination documenting physical injuries.
As for the crucial point, that of consent, I cannot say with certainty in my conscience that there was an explicit statement of a clear and perceptible under the circumstances lack of consent for these acts” said the prosecutor.
The jury found the accused guilty by a majority, 5-2, with two jurors in the minority.
In the previous hearing, apologizing, the accused repeated what he had argued from the beginning, that everything was done with the girl’s consent and that he himself did not commit the act of rape, as pointed out in the indictment.
According to what she described, the girl wanted to change her clothes and because her ex-boyfriend had the key to the room, they went up together to the upper floor of the house where the party was taking place. The plaintiff said the door was locked without her knowledge and her ex-boyfriend grabbed her arms, gagged her and raped her, grabbing her hair to immobilize her.
According to everything reported, when the perpetrator allegedly completed his act, he called his 18-year-old friend, the owner of the house, from the girl’s phone and asked him to unlock the room, which he did.
The girl told her friends what happened and a few hours later she was walking through the entrance of the Volos Police Department, reporting that she was the victim of rape by her 18-year-old ex-boyfriend. He also accused the 18-year-old, in whose house the party took place, of complicity in the rape, who, however, voluntarily acquitted himself of the charges he was facing.
