He fell into the “Scorpio” well and is asking for millions in compensation

--

American millionaire from Chicago he asks from the beach bar “Scorpio” her Mykonos compensation of hundreds of thousands of euros, because he fell into an unattended well in the parking lot of the famous Wind Island store, breaking all his bones and being bedridden more than three months later!

The 33-year-old businessman, who in recent years visited Mykonos and was a regular “Scorpio” spending many thousands of euros on the first tables, he literally lives by a miracle. The Fire Department and a specialist rescuer had to set up an overnight operation to retrieve the severely injured American and he was transported by EKAV helicopter to a private hospital in Athens.

In fact, the rescue operation from the deep well was so difficult and dangerous that the rescuer was also seriously injured. In order to transport Tadas Vilimas to the USA, he had to get into a special first-class bed on the plane, while in a special hospital in America, he had his hands reassigned to all the bones.

The partyIn the lawsuit filed by the 33-year-old businessman through the law firm N. T. Agapinos & Associates and brought to the public by “THEME”, he describes in detail what happened that warm summer evening on the cosmopolitan island: “On July 24, I visited as a customer the world-famous entertainment center with the distinctive title “Scorpio” in the Paraga area of Mykonos.

At the time of my arrival at the beginning of the road leading to the business, employees in charge of parking the above business indicated to me by “blocking” the road that I must park my vehicle in a lot adjacent to the store in question, at the exact spot which they indicated to me.

In fact, they explained to me that all vehicles of the same “buggy” type are parked in that section of the parking lot and that unlike the other vehicles, I would take the key of my vehicle with me, which vehicle I would receive myself upon my departure from “Scorpion”, he mentions and in the following lines he emphasizes: “Indeed I parked at this exact spot and according to the instructions of the parking attendants, who stopped all the vehicles and directed them exclusively and only according to their instructions.

And my vehicle was left in accordance with the above at the specific point that was strictly indicated to me and the parking attendants in question undertook to guard it until I left the premises of the first defendant (i.e. the beach bar “Skorpios”) and received it in person . I clarify that the valets in question presented themselves as the parking managers of the “Scorpio”, that is, the first defendant’s business, and that I was not aware of the existence of the second defendant company (meaning the security services company that managed the “Scorpio” parking lot) nor did I choose her, reasonably considering that in order to serve the “Scorpio” parking area, they are its employees.

Under the sole responsibility of the company, with which I and my company had made a reservation at the center operated by it, I was advised that in order to enter the premises I must park in the area and in accordance with the instructions of the said parking officers, while during the reservation I was informed that it has a parking service”.

The fall
Everything that followed, and in fact, as he says, in complete darkness, is truly nightmarish. “While collecting my car after my stay and while walking as instructed in the car park, I fell into an eight meter deep unguarded well which was next to my car and in complete darkness. As a result of said unattended 8 meter deep well within a tourist business, I suffered a crushing and severe multiple bone injury in front of most eyewitnesses, namely my partner and another couple accompanying us.

By chance my life was saved solely because there happened to be a mattress, a car tire and water thrown at the bottom of the well, which combined by chance reduced the consequences of my fall. I remained all night in that particular spot trapped and seriously injured.

After being given first aid by the EKAV rescuers inside the well, I was eventually freed and pulled out hours later, thanks to the actions of the Mykonos Fire Department and the heroic EKAV rescuers who took me to the island’s Public Health Center in the early hours of the morning in order to provide first aid and then it was decided to transfer me immediately to the private Medical Center “Mykonia Health” from which it was decided to airlift me to Mediterraneo Hospital in Athens due to the seriousness of my condition.

Had it not been for the mattress and rubber by chance I would have been completely dismembered by the fall and would have either died or been totally disabled. The height from which I fell is equivalent to falling from the third floor of an apartment building! In other words, it is emphasized that the rupture of the wall of the well offered direct access to the void, while there was no canopy, light, sign or other safety measure for the well…”.

The injury

He miraculously escaped the heavy fall. But to this day he is tortured as his bones were broken. As he points out in his lawsuit: “I have suffered multiple fractures, i.e. fracture of the right pubic bone, non-displaced comminuted fracture of the right acetabulum, comminuted fracture of the right wing of the sacrum, hematoma and subcutaneous swelling of the buttock, secondary head injuries, while I also suffered from inability to walk/move and most other bone injuries.

In addition, the hospital certified that I am unable to walk at all, and further found that I have fractured my right ankle, right wrist, right hip and pubic bone, fractured right acetabulum (pelvis), fractured right hip (pelvis), bimalleio fractured right ankle (both bones broken), fractured right scaphoid (wrist), fractured right radius (wrist), fractured left rib, while I was also tested for the presence of drugs in my blood with a negative physical result. And the levels of pain that I experienced and continue to experience are extremely high, to the extent that I needed special pain management treatment with opiate pharmaceuticals. Besides, it is obvious that it is not easy for a person to endure the pain of a broken bone, so it is enough to imagine how much pain is caused by the simultaneous breaking of so many bones together. And it is not only the unbearable pains, but also the fact that to this day he is confined to the bed of pain.

“Regarding the opinions of the doctors who follow me in the USA where I live, I report that unfortunately I am under twenty-four hour home care until today. And my primary care physician confirmed in his opinion the multiple fractures I suffer from and certified that I must be bedridden with 24 hour care to perform basic living functions due to the extent of my injury for at least two months from my first visit.”

In his lawsuit, the millionaire businessman gives his personal stamp by referring to his life and businesses. “I am a young man of 33 years old who was in excellent health before the incident in question and of course I had absolutely no responsibility for my injury. I am a highly successful and robust entrepreneur in the USA, founder and CEO of two very important companies in the field of logistics.

In total, I am the owner of multinational companies and I employ about 100 employees, while a very important factor in my professional life is the continuous business trips from which I refrain due to my injury. My companies have offices in the US, Canada and Europe. In summary, I state that I am the president of www.aecparcel.com, Managing Partner of www.shipzee.com, Managing Partner of www.happyparcel.com, Managing Partner of www.3defence.com, Owner of MB Talentu Sprendimai (Employment Office in Kaunas of Lithuania where I am also a director employing 40 people) and finally I am also President of EXR Logistics Inc (domestic goods logistics company)”.

The legal point of view

The legal representative of the American businessman, Mr. Tellos Agapinos, points out to “THEMA” that “We report on behalf of our principal and upon his instructions that, since the above company refused to compensate him in compromise and is completely indifferent to his horrific injury through its own fault -even though he has been her customer for many years and together with his company has spent tens of thousands of euros in her store-, he gave us the order to file a compensation lawsuit of hundreds of thousands of euros and to send a related letter of protest to the US Embassy and the internationally renowned “members club” of common interests with the above company.

We express the indignation of our principal for the unprecedented negligence of the business in question, which demands tens of thousands of euros from each reservation in its store, but does not even take basic security measures to protect its customers.”
