In the company SGB HELLENIC PROPERTY CONSTRUCTION COMPANY S.A. a fine was imposed by the Interagency Market Control Unit (DIMEA), regarding violations of the provisions on fictitious discounts and offers, as well as non-compliance with consumer legislation.

Regarding the fine imposed by the Ministry of Development following an inspection by the Interagency Market Control Unit (D.M.E.A.) on an inactive website (landing page) of our online store www.leroymerlin.gr for alleged sale of products under a price reduction regime, without including the sales price information before and after the price reduction was applied, we listed all the necessary information and clarifications, according to which:

The specific website (landing page), which stated “Offers on all LUXENS colors of the paint machine – FREE VAT” and on which 26 codes are displayed, it did not constitute an announcement of a price reduction and therefore, there is no violation of Article 78 (2) of Law 4177/2013.

This is a website that, as is often the case in e-commerce, was related to a specific campaign and had ceased (years ago) to be active immediately after it ended. It was not even accessible through the LEROY MERLIN online store. It was left in the archives of the world’s search engines, with zero traffic (according to Google data), along with thousands of such inactive campaigns, which have expired. It is also pointed out that the listed 26 codes are not sold (and never were) through the company’s online store, as they concern “machine colors”, which are created on site in the physical LEROY MERLIN stores, to the measurements of each customer.

With these data, our company has already proceeded to the exercise of the prescribed legal remedies questioning the legal and substantive validity of the fine.

What is most important for LEROY MERLIN – besides, of course, removing the misunderstanding that led to the unreasonable imposition of a fine – is to approach its relationship with its consumers with absolute transparency and integrity, always within the framework of the law and ethics.
