It is recalled that the Council of State (StE) had deemed the cuts to the main pensions unconstitutional and obliged the State to pay retroactive amounts to the beneficiaries.

However, the Supreme Court had deemed the corresponding cuts in the private sector constitutional, for reasons of public interest. If the AED judges that the SC and CA decided on other issues, then it will not proceed to examine the substance of the case and will reject it from the outset.
